Adaptation to Law 14.442/22 – Management of the Home Office in the workday service

  complementary way, the previous legislation
  regarding telework or Home Office (MP 1109),
  adding the type of service per day, to services
  per production or activity.

What is the objective of Law 14.442/22?

Regulate work from home office, through the requirements that the market has passed and is passing through, providing legal security for companies that adopt the home office model, whether by activity, production or per shift. It is important to mention that there is no jurisprudence, that it will be necessary to accompany the judiciary to understand the understanding on the subject.

What is Law 14.442/22?

MP 1108 is a provisional measure published in the official gazette on March 28, 2022, which was converted into law on September 2, 2022. And it aims to remedy some gaps regarding previously published legislation on Telework or Home Office.

When does Law 14.442/22 start to apply?

As a provisional measure, its validity is immediately after publication in the official gazette, which happens on March 28, 2022. It is worth mentioning that the measure is already in force, and companies that adopt the Telework or Home Office modality, need to adapt. Now converted into law already in force.

What concerns should you have regarding this Law?

Some important points about Law 14.442/22 are:

  1. Regular attendance at company premises does not detract from the Telework or Home Office regime;
  2. Union rules and collective conventions are established by the region where the company is established;
  3. Telework can be applied for interns and young apprentices;
  4. Determines that the food aid rules are intended exclusively for payment of meals or use in food products establishments;
  5. Brazilians working on a Telecommuting basis for foreign companies, the employee is subject to Brazilian legislation.

The contracting party is obliged to control the working hours of its employees who are in the Home Office, providing services per workday.
